Summary

We will explore the reasons for filing a Petition for Compromise of Minors and/or Incapacitated
Adults and the appropriate timing. This includes preparation of the forms and documents needed
for filing, understanding the distinctions between expedited and non-expedited filings, and where
to file in the various courts and the idiosyncrasies or things to avoid (or do) depending on where
you are filing. When to submit the Orders and, if necessary, open a blocked account. Learn the
key differences between settlement trusts, special needs trusts and annuities. What to consider
when exploring your options – is your client receiving any benefits, their age and their future
care. Learn what it means to structure a settlement, price out a life care plan, get an age rating,
the meaning of A+ and A++ insurance companies, and much, much more. Discuss why
settlement funds should be structured, the best type of structures and at what point during the
work-up of your case should you consider contacting a “structure person or persons” and when
to hire a probate attorney.
