Summary

It is the duty of government to safeguard civil rights and prevent harm from being caused by government employees and dangerous conditions of public property. However, it is difficult to hold public entities accountable due to the various immunities and protections afforded to public entities against tort liability. There are legal hurdles to succeeding on government claims, which include such things as proving notice, control, and the reasonable foreseeability of the risks. As for violations of civil rights, the successful plaintiff needs to demonstrate patterns of similar violations, deprivations of civil rights, disregard of risks, and that the government employee acted with the requisite level of intent which can vary depending on the amendment alleged to be violated.
