Summary

On May 12, 2022, the California Legislature resolved one of the thorniest disputes in state politics by raising a cap on medical malpractice damages for the first time in 47 years. Starting January 2023, the cap will increase, multiple caps will become available, and attorney’s fees will increase. With this new legislation in place, more and more attorneys are becoming interested in getting involved with medical negligence cases. The focus of this webinar will be teaching the specifics of litigating medical negligence cases, as well as the changes MICRA’s revamp brings, to include:

(1) Tips and tricks on vetting a potential medical malpractice case and the art of issue spotting. Attendees will learn how to properly select a potential medical malpractice case and spot “red flags” that may sink an otherwise attractive-sounding case;
(2) “Leveling the Playing Field – the CCP 425.13 Hammer.” This will be a talk on punitive damages in the med mal context and how it serves to level the playing field;
(3) Other “how to’s” & “how not to’s” of medical malpractice: CCP 364 letters and why not do to them; MSJs and their roles in med mal cases; common motion in limine issues;
(4) Everything you need to know about the new MICRA rules: new caps, new fees & new retainers.
